Marijuana Still Not Legal In National Parks

A lot of the cannabis community loves to go on hikes and, more than likely, sneak in a little toke along the way. We all have those friends that enjoy doing outdoor activities and medicating, and there’s nothing wrong with that as long as you are in a medicinal state. Now more than ever people are getting caught in Yosemite, Redwood, Death Valley and other federal lands across the state.

Even though recreational marijuana legalization was just passed last November there are still a lot of places that are off limits if you plan on medicating while you’re out and about. Federal parks and federal land have always been off limits when it comes to consuming alcohol or marijuana.

“Marijuana – recreational, medical or otherwise – remains prohibited on federal public lands and property, regardless of state laws, so there is no change: We will continue to enforce marijuana prohibition as before.” said Andrew Munoz, Pacific West spokesman for the National Park Service, as reported by The Sacramento Bee. For some reason a lot of people are under the impression that it’s ok to puff in public(maybe they are high), well the law openly states that marijuana consumption is only legal in private places.

For a better understanding of exactly why it’s illegal Mike Mitchell, a Fresno defense attorney gave his insight “A lot of people don’t recognize that you are going into a completely different jurisdiction; it’s just like going into a different state. A lot of people don’t know that. They think they’re going into a park, like any other California park.”
If you want to enjoy yourself outside while being medicated there are plenty of ways to do that without getting in trouble. Smoke in the car, however you will need a driver because California is now administering breathalyzers for marijuana intoxication. Our most simple solution, take a vape pen and be mindful of your surroundings. Is that instagram post of you smoking on top of a beautiful summit really worth the citation?
